A Listing Syndication Discussion

There has been a great deal of talk and writing lately about MLS/broker listing syndication. This isn't surprising considering one of the leading synidcation providers, Threewide, was recently acquired by Move, Inc., operator of Realtor.com. At the same time, initiatives like those led by industry veterans Bud Fogel and Mike Meyers and by LPS's Ira Luntz (himself a veteran of syndication), suggest that a new model could be in the offiing. Among commentators who have taken up the issue are MRIS Chief Marketing Officer John Heithaus, in an often-discussed post; Victor Lund of the WAVGroup(you need to be in Inman subscriber to read that one); and Rob Hahn.

Elizabeth and I wrote a longish whitepaper on syndication back in 2008, which is still available on our firm web site. That paper, written just before Elizabeth and I formed our firm together, focused on the role of MLS and how MLSs should approach operational and legal issues; it assumed that MLSs would want to do syndication because at least some brokers wanted syndication. Most of the concerns we expressed then remained unaddressed in the industry. The current debate, it seems to me, is about whether brokers and MLSs should be doing syndication at all. It takes up the key assumption in our 2008 whitepaper.

I'd like to expend some effort and thought on this topic in the next few posts. This first one will define what I mean by "listing syndication," in order to distinguish it from other forms of listing data distribution and licensing; and it will discuss some reasons MLSs get involved in syndication. In the next post, we'll consider ways that MLSs get involved in syndication and some problems and issues. Then we'll take a look at the key underlying question: should brokers be sending listings to all these places in the first place, and what role should MLSs play in that decision?

“Syndication” defined

There is no official definition of “listing syndication.” There is no Platonic universal or form corresponding to listing syndication. So, we just need a practical definition that provides some scope to what we are talking about. For this summary, I will use the following definition:

"Listing syndication is the distribution in bulk of active real estate listings (listings currently available for sale), by or on behalf of the listing agent or listing broker, to sites that will advertise them on the web to consumers, excluding IDX sites and VOWs operated by MLS participants/subscribers .”

We include each of the following things in this definition:

  • Distribution of listings by MLS through a listing syndicator, such as ThreeWide (ListHub) or Point2, to advertising sites.
  • Direct distribution of listings by MLS to advertising sites (including local newspaper web sites and national sites).
  • Distribution by a listing broker via a data feed (whether broker-internal or created by MLS on the broker’s behalf) to advertising sites.
  • Use by a broker or agent of a service that offers to take a bulk data feed and then distribute the listings to advertising sites.

I usually call web sites that advertise real estate listings “aggregators” (we used "commercial distributors" in the 2008 report). I usually refer to the recipients of data through syndication as “syndication channels.” As a result, a site like Zillow.com is both an aggregator and a syndication channel. I do not consider the following syndication (at least for purposes of this discussion), though they share some characteristics with it:

  • Services where agents manually load their own listings in, like vFlyer and Postlets. These sites generally do not take bulk data feeds.
  • IDX and VOWs. IDX and VOWs are similar to syndication, in that listings are distributed in bulk to folks who build web sites for advertising (and other) purposes, but those sites must be operated on behalf of brokers participating in the MLS. They are also subject to separate rules tailored for these specific purposes. In other words, the broker receiving an MLS IDX feed is bound to use or not use it according to MLS rules. IDX feeds may, and VOW feeds do, also include off-market listings; see my note about that below.
  • Data licensing to RPR or CoreLogic under their current proposals. They are using off-market listings, in addition to active ones, and the applications they use them for are not advertising. Sending data to Move, Inc. for its Find application is not syndication because it includes off-markets; but see the discussion relating to that below.
  • A “back-office data feed” from MLS to the listing brokerage. A back-office feed often includes all the MLS listing data (from all brokers) and comes with a license for the brokerage to use the data internally for the core purposes of MLS and the freedom to use its own listings any way it pleases. Many MLSs provide such feeds to their participants to facilitate brokerage business activities. Thus, though MLS’s action here is not syndication, the brokerage might turn around and engage in syndication itself.

Why only active listings? We do not include off-market listings (listing records relating to properties not currently for sale) in our definition of syndication for two reasons:

  1. MLSs perceive the off-market listings as something different. Most MLSs recognize that very recent off-market activity in the MLS provides a very valuable resource, one not available elsewhere. Thus very few MLSs distribute off-market listings through typical syndication channels.
  2. Brokers perceive the off-market listings as something different. Brokers want their active listings advertised (and their sellers want it, too). But brokers rarely perceive value in having their off-market listings distributed. We are not acquainted with any brokerage firm that distributes its off-market listing data.

The value MLSs bring to syndication

Almost from the beginning of “listings on the Internet,” people have asked what role the MLS should play in getting listings out there. The short answer is efficiency:

  1. MLS already has all the listing content in one database. Every listing broker has already paid for that database to be created and maintained; and every such database has the capability to export listing data. In theory, at least, it should always be cheaper for MLS to ship brokers’ listings to a channel, because it requires fewer steps. In the alternative, MLS would supply each broker a data feed of its own listings, then each broker would have to set up a feed to each channel (or at least set up a feed to a syndicator who could reach the channels). That’s a lot more data feeds, IT staff hours, etc.
  2. Many MLSs and traditional syndicators permit broker ease-of-use. Syndicators like Point 2 offer brokers a dashboard where they can click on the channels they want to receive their listings and click off the ones they don’t want to receive them. In theory, this does not require the broker to perform research and due diligence on each channel; the syndicator or MLS has theoretically done that before presenting the option on the dashboard. (In practice, this may not be happening.)
  3. Syndication through MLS or a syndicator may give listing brokers more leverage. If a channel is getting the listings from many brokers in MLS through a data feed from MLS, the MLS may have leverage with the channel to get it to behave properly. If the MLS cuts off the data feed, the channel loses listings from all the brokers. Similarly, if a syndicator cuts off a feed to a channel, the channel loses the feed for all the MLSs working with the syndicator. A single broker, by comparison, usually does not have the volume of listings to exert leverage on the channels. Note that some channels (like Google, before it decided to stop accepting listings), did not necessarily react to that leverage anyway. Note also that just because MLSs and syndicators have this leverage, that does not mean they have actually used it (I'll discuss this in another post).

The resourceful broker problem

One important fact about syndication is what we call the “resourceful broker problem.” It’s not really a problem at all; it’s just competition. If an MLS does not syndicate listings on behalf of its brokers, some of the brokers will assume the costs and work associated with syndicating their own listings. This will give those brokers a competitive advantage in the market. Note that we don’t call this the “large broker problem.” Though the large brokers in markets are also often resourceful brokers, in many cases, smaller brokers also find the means to be resourceful. The MLS is confronted with its age-old problem, almost its nemesis: Choose between (a) delivering services at the lowest common denominator, drawing complaints from some brokers that MLS should be doing more to deliver efficiencies to all brokers; and (b) delivering efficient services to all brokers, drawing complaints from resourceful brokers that MLS is “leveling the playing field.”

Neither of these arguments is wholly right or wrong. But they appear in some form whenever MLSs consider offering services like syndication. The intensity of feeling about which path the MLS should take varies a great deal from MLS to MLS and often within the board room of a single MLS.

So, we've stipulated a definition for "syndication"; should we be including other things, or perhaps excluding something I've included here? And we've discussed why MLSs often believe they should be involved. I'm curious what your thoughts are about my efficiency arguments there. Next time, we'll consider some ways that MLSs do, and don't, syndicate. Following that, I'd like to spend a little time considering where brokers should be sending their listings and whether the MLS should be deciding for them.

Great post Brian. This is a hugely important topic, so nailing down a definitional starting point is certainly needed.

Is it redundant to incorporate the notion that syndication is meant for sites/entities that are not participants in a given MLS? While perhaps implicit, I do think it helps to clarify that the intended destination of syndicated listings is typically to sites that otherwise do not have rights to such data via affiliation with an MLS or broker/agent.

With respect to the value MLS's bring to the table in syndication, we shouldn't underestimate the data accuracy & currency that MLS's typically provide. WAV's study among others has shown that MLS websites are the most current, and the more steps removed from the MLS as a data source, the lower the data quality. This is important to all stakeholders in the transaction, from consumers (both buyers and sellers) to agents & brokers and the MLS's which they are affiliated.

I'm looking forward to a much more open and creative discussion around the "syndication problem" we've all heard so much about.

Where do you put IDX in the mix of the definition of syndication, Brian?

Brian.. I am glad you called it a discussion dear sir….. With my eyeballs bulging and a huge smile.. I begin to ramble the following..
After my first blog post in July on Syndication after I was at the end on my ropes with compliance issues... 90% going back to syndication, and some not so good ideas... It dawned on me.. Over-syndication is the devaluation of syndication... ( http://ageekblog.com/syndication/ ) A song I have been singing for well over a year.. My love hate relationship with syndication..
Syndication is also the first tool I have seen that some channels reselling leads, actually drive traffic away from the listing broker, to the broker with the most money..
Or there was the broker who called me screaming because I had placed her listings on a for sale by owner site…. “No mam I explained”…. “You did”… That is not what customer service at the MLS is like.. I should not feel like my geeks or I have zero control over a technology benefit.. but we don’t….
Syndication is a MLS benefit product for members.. But it is one the MLS has very, very little control and almost zero management over.
When syndication was king and everyone loved Camelot.. (Those of us who jumped on board that first train) there were very few.. but very good engines and channel partners data was being sent to..

So.. Good data.. Few channels... Good partners = excellent product...

Then came the Oodle days of re-syndicating syndication (they spit it back out to well over 200 channels.. small print... I know..)

Then.. Housing market declines... mls #'s declines.. staff declines as did the ability to have a single staff member for compliancy...

So it seems the fix would be easy (or is it..)

Have syndication as a member benefit.. It IS valuable....

as a free benefit, syndicate to those primary channels.. The good partners responsible for 85% of the web search traffic for housing anyway...

For a paid OR a you do on your own service.. All those I have no clue who you are channels that over-syndicate and re-syndicate.. Pay or do it on your own...

Another missing tool for the MLS is detailed analytics for looking at the what, when, who, and where of the data, and simple tools to manage that data when a member needs help…
Once an MLS signs up for syndication.. Like you say… It is the Broker syndicating his/her listings then when the member needs help or assistance there is not even a login for the MLS to help their member.. And that’s what hits me the hardest as I beat techs on customer service.. The importance of good technical service….
Syndication is the only technology which Brokers need, that has cost more money than it has brought in, and has cost more in compliancy hours and legal costs than any other single product we have ever implemented…
You can educate, educate, educate and educate.. But at the end of the day the broker with an issue had no clue where they were even syndicating their re-syndicated listings to, and all the time as more data is collected and stored.. So goes down the value of the data.

Is there a good solution? Well.. in technology when things get crazy complicated the one thing that will always fix a technical problem is going back down to the basics.. The plain vanilla.. And rebuilding without the mistakes that were made the first go around…

Syndication is absolutely a nightmare on many levels - the control of the data quality is gone - leaving behind dregs like duplicate data, false data, reproductized data, resold data, loss of ownership by brokers, loss of copyright by MLSs, reduction in the quality of curated listing content - yadda, yadda.

Like you, I believe that the industry is reaching an inflection point. Change is happening. New Models are emerging, brokers are getting wise, and franchise organizations have thrown their hats into the game of national search. All on the footsteps of Trulia's plans of an IPO.

Jonathan/Rob: I revised the definition to clarify we are not talking about IDX/VOW. Because they have their own separate rules and policies, I just assume they are something different (though they have some similarities to syndication and in some cases raise similar problems/issues).

SPOT on! The MLS role should absolutely be one of improving the consumer experience. This must be done through a vigilant exercise that sets and enforces (through the leverage Brian aptly notes) some very basic rules such as taking listings down automatically if their expiration dates are past. Of course this means SENDING the expiration date in the first place. Well to do that, the syndication site must agree to certain terms of disclosure. How about a status/price checker? MLSs manage this all day long- so it is about time we require the syndication sites to do the same.

Basically, it must come down to leverage, requiring these sites to agree to “our” terms and conditions, not unreasonably- and then putting automated processes and applications in place to track compliance and manage the listings.

Definitions are great, and conversations continue… the time is NOW to move this conversation to consensus and actions.

I don't think IDX/VOW can be separated from this syndication conversation, though. The core issue, as I see it, is whether real estate listings are advertisements or proprietary content to the people doing the data entry: the brokers and agents.

All of Victor's objections to syndication, for example, are 100% spot on if, and only if, listings are seen by all involved as proprietary content. Then things like data accuracy, control of data quality, and so on matter to the degree that MLS/vendors/consultants think they do.

If, on the other hand, listings are ads, then I don't know that any of those things ultimately matter to the brokers and agents who do the work, and pay for the MLS.

IDX has the exact same characteristics here. If listings are ads, then IDX is not only a no-brainer but a real value to the listing broker who is benefiting from increased exposure. If listings are content, then I don't see any reason why a broker would want his competitor to use his content to do lead generation at all.

Just my $0.02 here.

Rob: We need to discuss the points you've ID'd, but I have a couple reservations about doing it as the focus of this series.

First, I don't think it's necessary to say "listings are ads" OR "listings are proprietary content" exclusively. They can be proprietary content used at least part of the time for advertising purposes. Syndication is principally focused on such uses, and so is IDX. We WILL discuss that in this series.

Second, though it's quite possible that a discussion about syndication can lead to insights about IDX, I'd prefer to keep them separate at least initially for one simple reason: MLSs and brokers don't have the same freedom of movement with IDX as with syndication. Every NAR-affiliated MLS has to do IDX as NAR has dictated. Any broker who wants out of IDX has to give up having listings of other brokers on her site.

This syndication discussion will result in some observations with broader applicability (including to IDX, etc.); and any observation we make in the context of syndication should stand up when tested in the IDX environment. But I want to stay focused in this part of the conversation on the narrower topic.

I do challenge this oft-given response, though, that listings are BOTH valuable proprietary content AND advertisements. I don't believe the behavior of the industry participants suggest they believe it to be both.

It's more accurate to say, I think, that listings are ads for the brokers and agents, and proprietary content for MLS and Publishers. And therein lies the rub.

For one thing, if brokers/agents believed that what they were doing was creating valuable intellectual property (which many believe they do with things like blogging), wouldn't they behave in a very different way vis-a-vis the MLS?

In all of the conversations about listing syndication, no one ever speculates what the future holds for MLS in the age of almost universal consumer publishing capability on sites such as Facebook or other "social media" sites and advertising sites such as Craigslist.

I think syndication could be a survival step for MLSs and Associations (and consultants).

MLSs, as well as agents and brokers, need to continue to evaluate their value proposition.

Now I know we are all worried about someone else having our data, loss of control, etc...but what is the value of the data...really? Can any of my friends quantify it for me? Is looking at the profitability of Zillow, Trulia and the like one way to measure the value of the data MLSs provide to them?

If we think things are moving fast now, just wait.

Maybe if we called this Listing Distribution instead of Listing Syndication more people would understand and participate in the conversationd.
